The long awaited “no fault” divorce is due to become law on 6 April 2022.

The government announcement last year that the Divorce, Dissolution and Separation Act 2020, was to be delayed by at least six months disappointed many separated couples seeking to divorce in the most amicable way, with the least impact on their children.

2022 will finally see the Act made law and the ‘no fault’ divorce available to all couples from April.

Paralegal Laura Somoza said: “This will massively help couples divorce in a more amicable way as previously there was no other option to begin the process other than citing unreasonable behaviour or adultery. Being able to divorce without apportioning blame will reduce the contentious element and ultimately benefit them and their children.”

This legislation has been a long time coming, and while the delay was frustrating  it was important to make sure everything was in place and the courts given the necessary time to ensure a smooth process.
